WizzyMaids – Terms & Conditions, Refund & Cancellation policy

These Terms & Conditions (“Terms”) together with the Refund & Cancellation Policy (“Policy”) govern the access to and use of the WizzyMaids platform, including its website, mobile applications, and related services (collectively, the “Platform”). By accessing or using WizzyMaids, you agree to be bound by these Terms and Policy. If you do not agree, you must not use the Platform.
1. Definitions
- “WizzyMaids” / “Company” / “We” / “Us” – Refers to WizzyMaids, a domestic staffing platform.
- “User” – Any individual accessing the Platform, including Customers and Service Providers.
- “Customer” – Individuals seeking domestic services.
- “Service Provider” – Domestic workers registered on the Platform.
- “Services” – Discovery, booking, and payment services provided by WizzyMaids.
- “Applicable Law” – Includes the Information Technology Act, 2000, DPDP Act, 2023, and Indian Contract Act, 1872.
2. Nature of Platform
- WizzyMaids is a technology-enabled facilitation platform.
- WizzyMaids is the employer of Service Providers, supervising and managing them.
- All services are provided by Service Providers to Customers under WizzyMaids.
- Any agreement for services is strictly between the Customer and WizzyMaids.
3. Eligibility
To use WizzyMaids, you must:
- Be at least 18 years of age.
- Have legal capacity to enter into a binding contract.
- Provide accurate and complete information.
WizzyMaids reserves the right to deny access to any user at its discretion.
4. User Account Obligations
Users agree to:
- Maintain confidentiality of login credentials.
- Provide true, current, and complete information.
- Notify WizzyMaids of unauthorized account use.
Users are solely responsible for all activities conducted through their account.
5. Service Provider Verification Disclaimer
While WizzyMaids may:
- Collect identity documents.
- Conduct background or police verification.
WizzyMaids does not guarantee:
- Skill level.
- Character or conduct.
- Suitability for a specific household.
Customers are advised to exercise independent judgment.
6. Booking, Payments & Fees
- Payments are processed via third-party payment gateways.
- WizzyMaids may collect platform or convenience fees.
- Prices may vary by service type and location.
- WizzyMaids reserves the right to modify fees at any time.
- WizzyMaids is not responsible for payment failures caused by banks, UPI providers, or third-party gateways.
7. Cancellations & Refunds
This section integrates the Refund & Cancellation Policy:
7.1 Cancellation by Customer
- Before Service Assignment – Refunds may be initiated, excluding platform fees, gateway charges, and administrative costs.
- After Service Assignment – No refund is guaranteed; deductions may include platform fees, Service Provider compensation, and operational charges.
- Same-Day or Last-Minute Cancellations (<24 hours) – Non-refundable.
7.2 Cancellation by Service Provider
- WizzyMaids may attempt a replacement, subject to availability.
- If replacement is not possible, WizzyMaids may issue a partial or full refund at its discretion.
- WizzyMaids shall not be liable for inconvenience, delay, or consequential losses.
7.3 No-Show Policy
- If the Customer is unavailable, unreachable, or denies service at the scheduled time, the booking is treated as a Customer No-Show.
- No refund shall be issued.
7.4 Refund Eligibility
Refunds may be considered only if:
- Payment was deducted but service not initiated.
- Duplicate payment occurred.
- Service was cancelled by WizzyMaids without Customer fault.
Refunds are not applicable for dissatisfaction with Service Provider behavior/skill, early termination, partial services, change of mind, or external factors beyond WizzyMaids’ control.
7.5 Subscription & Advance Payments
- Subscription fees are non-refundable once the subscription period begins.
- Unused days, hours, or sessions are not eligible for refunds.
- Paused or discontinued services do not qualify for prorated refunds.
7.6 Refund Processing
- Approved refunds will be processed within 7–10 working days.
- Refunds will be credited to the original payment method only.
- Payment gateway delays are outside WizzyMaids’ control.
7.7 Deductions & Adjustments
WizzyMaids reserves the right to deduct:
- Platform and convenience fees.
- Taxes (if applicable).
- Payment gateway charges.
- Compensation paid or payable to Service Providers.
7.8 Fraud, Abuse & Policy Violations
No refunds shall be issued if:
- Fraudulent activity is detected.
- False claims or misuse of the platform occur.
- Attempt to bypass platform payments is identified.
- User violates Terms & Conditions.
8. User Conduct & Prohibited Activities
Users agree not to:
- Harass, abuse, or discriminate.
- Share false or misleading information.
- Circumvent platform payments.
- Use the Platform for illegal activities.
- Attempt unauthorized access or data extraction.
Violation may result in immediate suspension or termination.
9. Intellectual Property Rights
All content, trademarks, logos, software, and platform materials are the exclusive property of WizzyMaids. Users may not copy, modify, distribute, or exploit any content.
10. Privacy & Data Protection
Personal data is governed by the WizzyMaids Privacy Policy. By using WizzyMaids, you consent to data processing in accordance with:
- DPDP Act, 2023.
- Information Technology Act, 2000.
11. Third-Party Services & Links
WizzyMaids may integrate third-party services. We are not responsible for:
- Third-party content.
- Payment gateway failures.
- External websites or services.
Use of third-party services is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law:
- WizzyMaids shall not be liable for acts, omissions, or misconduct of Service Providers.
- WizzyMaids shall not be liable for personal injury, theft, loss, or damages at Customer premises.
- WizzyMaids shall not be liable for indirect, incidental, or consequential damages.
Total liability, if any, shall not exceed the platform fees paid to WizzyMaids in the preceding 3 months.
13. Indemnity
Users agree to indemnify and hold harmless WizzyMaids from:
- Claims arising from misuse of the Platform.
- Breach of these Terms.
- Violation of Applicable Law.
- Disputes between Customers and Service Providers.
14. Suspension & Termination
WizzyMaids may suspend or terminate access:
- Without prior notice.
- For violation of Terms.
- For security, legal, or operational reasons.
Termination does not waive accrued rights or obligations.
15. Force Majeure
WizzyMaids shall not be liable for failure or delay due to:
- Natural disasters.
- Government actions.
- Network failures.
- Pandemics, strikes, or public emergencies.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Courts at Greater Noida, India shall have exclusive jurisdiction.
17. Dispute Resolution
Disputes shall be resolved through:
- Good-faith negotiation.
- Arbitration under the Arbitration and Conciliation Act, 1996.
- Seat of arbitration: Greater Noida.
- Language: English.
18. Amendments
WizzyMaids may modify these Terms or Policy at any time. Continued use after updates constitutes acceptance.
19. Severability
If any provision is held invalid, remaining provisions shall remain enforceable.
